A special note about K-1 Fiancé Visas and K-3 Marriage visasThe K-1 Fiancé visa process takes time. In most cases a K-1 Fiancé visa petition must be entered at an American Consulate in the country of your fiancé. The petition will take up to 120 days for approval. Upon approval, the applicant may enter the United States. There are health and other legal background checks that will be required for approval. Applicants with a communicable disease or a severe physical or mental disorder may be denied approval. Applicants who are ineligible for U.S. citizenship because of a criminal background will also be denied. The applicant must also supply a variety of documents supporting the petition, as well as prove that he or she has physically met the intended spouse. The marriage must take place in the United States within ninety days of arrival in order to apply for a K-3 Marriage visa.
